Our Terms

Online and Offline Matchmaking Service 

These Terms and Conditions ("Agreement") govern the use of the online and offline matchmaking services ("Services") provided by Compatico Ltd ("Company"), a New Zealand based company. By accessing or using the Services, you agree to be bound by this Agreement. If you do not agree to these terms, please refrain from using the Services. 

1. Eligibility:  
1.1 You must be at least 18 years old to use the Services and understand that the service was designed for single people over the age of 30. 
1.2 By using the Services, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all the terms and conditions herein.  
1.3 Membership will only be accepted and services provided at the sole discretion of the Company.  

2. Registration and Account: 
2.1 In order to access and use the Services, you must create an account ("Account") by providing accurate and up-to-date information.  
2.2 You understand and accept the different types of memberships provided and their differing service levels and pricing.   
2.3 You agree to notify the Company immediately of any breach of security or information that you become aware of.  

3. Services Provided: 
3.1 The Company offers matchmaking services both online and offline, connecting individuals for potential relationships based on human insight and agreed compatibility factors.  
3.2 The Company does not guarantee any specific results or matches, as compatibility is subjective and depends on various factors.  
3.3 The Company reserves the right to modify, suspend, or discontinue any part of the Services at any time without prior notice.  
3.3.1 Should the Company elect not to provide services, or for exceptional circumstances or terminate your membership and deactivate your Account for any reason within 5 working days of you paying the fee and/or the Company receiving your Ministry of Justice information (whichever is the later), the Company will provide a full refund less costs incurred for services to date. 
 3.3.2 Any member who has their Membership suspended or cancelled as a result of violating the terms of this agreement is not entitled to a refund. 

4. User Obligations: 
4.1 You agree to provide accurate and up-to-date information about yourself when using the Services.  
4.2 You are solely responsible for the content you provide on the Company's platforms, and you agree not to provide any content that is false, misleading, defamatory, offensive, or violates any applicable laws or third-party rights.  
4.3 You agree not to use the Services for any unlawful purposes or to engage in any illegal activities.  
4.4 You agree to treat other members and the Compatico team with respect and to refrain from harassing, stalking, soliciting, or threatening any individual.
4.5 The Company reserves the right to suspend or terminate your Account, if you violate any provision of this Agreement.  
4.6 The Company reserves the right to restrict your access to Compatico events for inappropriate behaviour or harassment towards other members or the Compatico team.

5. Privacy Policy:  
5.1 The Company's Privacy Policy governs the collection, use, and disclosure of personal information provided by users. By using the Services, you consent to the Company's collection and use of your personal information as outlined in the Privacy Policy.  
5.2 During the course of interviewing you the matchmaker will, by necessity, make notes in order to refine what characteristics a suitable match might need to have for you. These notes may include cross references to other clients who may be suitable for you and are informal in nature. These notes do not form part of your personal information. Any notes are part of the Company’s intellectual property and belong to the Company.  

6. Intellectual Property:  
6.1 All intellectual property rights in the Services, including but not limited to trademarks, logos, graphics, and software, are owned by or licensed to the Company.  
6.2 You agree not to copy, modify, reproduce, distribute, transmit, display, or create derivative works from any part of the Services without the Company's prior written consent.  

7. Limitation of Liability:  
7.1 The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Services.  
7.2 The Company's total liability, whether in contract, tort, or otherwise, shall not exceed the fees paid by you for the Services.  

8. Indemnification:  
8.1 You agree to indemnify and hold the Company, its affiliates, officers, directors, employees, and agents harmless from any claims, damages, liabilities, and expenses, including reasonable legal fees, arising out of or in connection with your use of the Services or any breach of this Agreement.  

9. Governing Law and Jurisdiction:  
9.1 This Agreement shall be governed by and construed in accordance with the laws of New Zealand. The Company acknowledges its responsibilities under the Human Rights Act 1993 and the importance of freedom from discrimination. The Company’s service was designed in good faith to advance the interests of persons aged 30 and above against whom other dating services may directly or indirectly discriminate and to assist those persons to achieve an equal place with other members of the community. Acknowledging that our services are designed to advance the interests of this age group, the Company reserves the right to decline to provide services to persons under 30 years of age.  
9.2 Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of New Zealand. 

10. Entire Agreement:  
10.1 This Agreement constitutes the entire agreement between you and the Company regarding the use of the Services. All members must sign a Membership Agreement in order to access the Services.  
10.2 The Company's failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.  
10.3 The Company does not provide any warranty or guarantee that it will be able to find the right match for you. The Company will use its best endeavours to screen any match made by its matchmakers as part of its Services but bears no responsibility for the outcome of any such match. The Company does not provide any warranty as to the conduct of any of its clients nor can it vouch for the accuracy of any information provided to the Company and relied upon by the Company as a part of any screening or matchmaking services.
